  1. SERVICES

LIFT provides a range of workshops, events, membership, facilitation and coaching services all referred to as “programs” in this document. You as the client agrees to abide by all policies and procedures as outlined in this agreement as a condition of their participation in any Program.

  1. WHAT IS INTERACTIVE, INTUITIVE, TRANSFORMATIVE PROGRAM INCLUDING COACHING?

All of LIFT’s programs are a partnership (defined as an alliance, not a legal business partnership) between a LIFT facilitator, coach or keynote speaker and the Client / you in a thought-provoking and creative process that inspires the client to maximise personal and professional potential. It is designed to facilitate the development of personal, professional or business goals and to develop a strategy/plan for achieving those goals.

  1. DISCLAIMER

The Client acknowledges that LIFT programs do not involve the diagnosis or treatment of medical conditions or mental disorders and that facilitated process or coaching is not considered as or used in any way to substitute for counselling, or other mental health professional advice, and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If the Client is currently under the care of a mental health professional, it is recommended that the Client promptly discuss with them the personal/professional development work they are participating in with LIFT.

  1. LIFT CLIENT LEARNING RELATIONSHIP
  2. All LIFT coaches are members of the International Coach Federation “(ICF)” and uphold the ethics and standards of behaviour established by ICF.
  3. The Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching/learning relationship The Client understands coaching and all LIFT programs are not therapy and do not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  4. The Client acknowledges that coaching and all LIFT’s programs involve a comprehensive process that can review and relate to different areas of his or her life, including work, finances, mental, physical and emotional health, relationships, education, family and past trauma. The Client agrees that deciding how to handle these issues, incorporate coaching or learning principles into those areas and implementing choices is exclusively the Client’s responsibility.
  5. The Client understands that in order to enhance the coaching or learning relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
  6. CONFIDENTIALITY & BEHAVIOUR
  7. The LIFT-Client relationship, as well as all information (documented or verbal) that the Client shares with LIFT as part of this relationship, is supported by the principles of confidentiality set forth in the ICF Code of Ethics.
  8. However, please be aware that the LIFT-Client learning relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognised privilege.
  9. LIFT agrees not to disclose any information pertaining to the Client without the Client’s written consent. LIFT will not disclose the Client’s name as a reference without the Client’s consent.
  10. The Client agrees to maintain behaviours in all LIFT programs that support a positive focus, demeanor and respect for themselves and the differences in a group. Including being empathic, kind and generous rather than judgmental, controlling, aggressive or disengaging.
  11. Confidential Information does not include information that:
    1. was in the Coach’s possession prior to its being furnished by the Client;
    2. is generally known to the public or in the Client’s industry;
    3. is obtained by the Coach from a third party, without breach of any obligation to the Client;
    4. is independently developed by the Coach without use of or reference to the Client’s confidential information; or
    5. the Coach is required by statute, lawfully issued subpoena, or by court order to disclose;
    6. is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and
    7. involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
    8. RELEASE

The Client consents to photographs and/or video being made of workshops and events. The Client consents to videos and audio recordings made during LIFT programs to be used by LIFT for future programs and marketing materials at no fee.

The Client consents to its name, voice, and likeness being used by the Client for future learning programs and marketing materials at no fee.

Should the client not want their image to be photographed or part of event videos to be used, please advise LIFT by emailing [email protected] with Subject in the title “Image permission denied”.

  1. CANCELLATION POLICY

Coaching

The Client will notify LIFT 48 hours in advance of the intended cancellation of scheduled calls/meetings. LIFT reserves the right to invoice the Client for a missed meeting if it cannot be rescheduled.

Workshops & Keynotes

The Client agrees to email [email protected] no later than 14 days prior to the workshop and understands there are no refunds under 14 days. In addition, any travel or accommodation expenses that can not be refunded to LIFT from suppliers will be reimbursed by The Client.

Substitutions

Participant substitutions are permitted only if prior consent is obtained by LIFT Performance Solutions. The Client agrees to email [email protected] to advise of any substitution no less than 5 days out from the workshop.

  1. SHARING / TRANSFER OF MEMBERSHIPS OR PACKAGES

Learn Packs

If purchasing three (3) or more of the LIFT Learn workshops, the workshops can be shared across different staff within your organisation. Please liaise with LIFT on [email protected] to confirm attendee details to ensure we keep in touch with them on key event information and preparation work required for the workshops.

Grow and Transform Membership

Grow and Transform Memberships are designed for a single leader to embark on a growing or transformative journey. Hence these memberships are not transferable to the other staff members.

In the event the designated participant is unable to attend the pre-scheduled workshops due to:

  • Illness or pre-arranged leave, they can attend the same workshop when next scheduled in the coming year.
  • Leaving the organisation, the membership can be transferred to another staff member within the same organisation to complete the remaining elements. Please note that prior consent must be obtained from LIFT (refer ‘Substitutions’ section under the Cancellation Policy in this document for further details).
  1. REFUNDS

Our aim is for everybody to be happy with LIFT’s services, but understand that may not always be possible As our Client, if you are unhappy in any way we’d want you to talk with us about what we can do better next time, and the process of a refund provided if no part of the program has been accessed. Contact us via the LIFT website mail [email protected] or free call LIFT to discuss further.

Please note attending live- online discussions, utilising and communicating with the LIFT community, and accessing web based digital content constitutes access to the Program.

  1. PAYMENT PLANS

If you commence a payment plan, you agree to make all payment instalments in your plan. If your workplace is paying for your workshop or membership program and you are unable to attend or leave that workplace, the remainder of the workshops or membership may be transferred to another employee. You must email [email protected] to request a transfer.

  1. NON-DISCLOSURE OF COURSE MATERIALS

LIFT’s programs are copyrighted. Material given to the Client is proprietary, copyrighted and developed specifically by LIFT. The Client agrees that such proprietary material is solely for the Client’s own personal use. Any disclosure to a third party is not permitted.

All intellectual property, including LIFT’s copyrighted programs and/or course materials, remain the sole property of the Coach.
